A FEMALE stripper accused of raping the best man at a bucks party has been found not guilty of the charge in a Melbourne court.
After less than a day of deliberation, the Victorian County Court jury found Linda Maree Naggs, 40, whose stage name is Tiffany, not guilty of the charge.
In evidence, the court had heard Naggs was the second stripper for the night at the September 2007 Mornington Peninsula party and came armed with a whip, vibrator and ``strap-on penis shaped'' sex toy.
The best man gave evidence at the trial of being pressured by his peers into sitting on the seat where Naggs performed her routine.
She stripped him, encouraged him to get on all fours and then put lubricant on him and began moving the dildo around his bottom area, the court heard.
Witnesses described how at one point the best man ``sort of screamed'' and winced.
The best man reported the alleged rape to police the next day.
Naggs appeared relieved as the verdict was delivered today.
She later wept as Judge Tim Wood formally discharged her.
Outside court, her lawyer James Dowsley said his client wished to thank the jury for the attention they gave to the case and their verdict.
Naggs smiled, but refused to answer reporters' questions as she left the court area. The complainant was not in court.
Yesterday, the defence lawyer claimed that the man who was naked and on all fours when allegedly raped by
Naggs stripper was behaving like someone ``playing chicken'' with moving cars.
Delivering his closing address, Naggs' lawyer Paul Higham said the man had hired the stripper to perform the XXX rated show called ``Anal'', prior to serving as the best man at his friend's wedding.
Mr Higham told jurors that after the groom decided he no longer wanted to take part in the performance the best man got naked and on all fours under his own free will.
He said the best man then allowed lubricant to be poured onto his bottom while a stripper stood behind him with a dildo strapped to her waist.
Mr Higham described the scenario as ``a bit like playing chicken with moving cars''.
He also questioned how the best man could be so sure the penetration by the dildo was deliberate.
``Why would she (Naggs) choose to deliberately commit this crime?''
Mr Higham urged the jury to find Naggs not guilty.
Earlier, prosecutor Kieran Gilligan reminded jurors that only the slightest penetration was sufficient to constitute rape.
``She knew what she had done,'' he said.
``It was intentional and she didn't expect (the best man) to act in the way he did.''
Mr Gilligan said Naggs described the incident as a ``joke''.
``Well it backfired, didn't it,'' he said.
Mr Gilligan urged the jury to find Naggs guilty.
``He never consented to any penetration and she intentionally penetrated him and this is rape and you ought to find her guilty,'' he said.
I posted this article, which was taken from the Daily Telegraph's website, as a contrast article to the one I posted last month about the girl who says she was raped after consenting to a sex act, then passed out from a night of drinking.
Do we have a double standard here? Was this man raped or not?
The other board post was called, "Man charged with rape. Judge says, "only a technical" rape"
i think if someone wants to get stripped and then have a penis shaped whatever poked round his backside, he has to take what's coming to him. a little slip, for lubricant was used, and bang. sorry, no sympathy here.
only in australia. what a wild country you live in. and no it was not a double standard. they guy was awake and asomewhat alert.
If he concented to it, was aware of what might happen, and said nothing, it wasn't rape. If, during any point, he said no and made himself clear and she continued, then I'd definitely call it rape, even without penetration cause she was forcing him. It really depends on what happened.
Whether this chick is guilty of rape or not depends on the communication between her and the man. If he told her no, stop, or tried to move away from the situation, and she continued, then this woman committed the crime of rape. If he consented to this, and showed no signs or spoke no words of contention, then I don't think this woman raped him.
